On behalf of KM associates, we hope that you and your families have made it through Hurricane Sandy safely.

The storm has caused widespread damage. If you were affected by the hurricane, you may need to repair your building immediately.

For your information, the New York City Department of Buildings (DoB) allows you to make emergency repairs without a permit. In accordance with Building Code Section 28-105.4.1, you can immediately stabilize unsafe structure, build sidewalk sheds for protection, fix gas leaks, and repair broken heating and hot water systems. For more information about this Code Section, see below.

In the meantime, the DoB has lifted the embargo for construction. If you are going to resume normal construction activity, make sure you adhere to the DoB regulations.

Building Code Section 28-105.4.1 Emergency work.
Work that would otherwise require a permit may be performated without a permit to the extent necessary to relieve an emergency condition. An application for a permit shall be submitted within two business days after the commencement of the emergency work and shall include written description of the emergency condition and the measures undertaken to mitigate the hazard.

Emergency work may include but shall not be limited to:

• Erection of sidewalk sheds, fences, or other similar structures to protect the public from an unsafe condition.
• Stabilization of unsafe structural conditions.
• Repair of gas leaks.
• Repair or replacement of heating or hot water equipment servicing residential occupancies during the heating season as established by the New York City housing maintenance code.
• Replacement of parts required for the operation of a combined standpipe or sprinkler system.
