NEW NYC BUILDING RULE MANDATES INITIAL PARKING STRUCTURE OBSERVATIONS

New York City’s Department of Buildings has introduced a pivotal regulation, 1 RCNY §103-16, requiring owners of parking structures within specific Community Districts to conduct a one-time initial observation by August 1, 2024. This mandate applies to parking facilities located in Manhattan’s Community Districts 8 through 12, as well as all Community Districts in Brooklyn, Queens, Staten Island, and the Bronx. The initiative aims to enhance safety standards for these structures, ensuring they meet the rigorous requirements outlined in Article 323 of Title 28 of the NYC Administrative Code and 1 RCNY §103-13. These regulations stipulate periodic inspections, with deadlines falling by December 31, 2025, or December 31, 2027, depending on the district. Notably, owners of parking structures in Manhattan’s Community Districts 8 through 12 and Brooklyn’s Community Districts who submit a periodic inspection report by August 1, 2024, will be exempt from the initial observation requirement, streamlining the compliance process. To ensure the integrity and professionalism of the observations, the Department of Buildings mandates that the initial observation must be conducted by or under the direct supervision of a New York State-licensed professional engineer designated as a Qualified Parking Structure Inspector (QPSI). Beginning in spring 2024, owners must submit their initial observation reports via DOB NOW: Safety by the August 1, 2024, deadline. This proactive approach underscores New York City’s commitment to maintaining the safety and structural integrity of its parking facilities, safeguarding both property owners and the public.
