Department of Buildings Service Notice – Local Law 109 of 2022: Rodent Abatement During Construction

Effective May 18, 2023, a licensed exterminator is required to treat the premises for rodent extermination, as required by the NYC Department of Health and Mental Hygiene (DOHMH), for the following work:

• Construction work involving 50% or more of the floor area of a building
• Vertical or horizontal enlargement increasing the building floor area by more than 25%
• Demolition of more than 50% of the floor area of a building
• Full demolition of a building.

Beginning June 6, 2023, if the applicant answered Yes to any of the below questions on the Plans/Work (PW1) in DOB NOW, the permit applicant will be required to certify on the PW2 that a licensed exterminator has been retained to effectively treat the premises for rodent extermination as per the requirements of DOHMH.

Full Demolition

All applicants for Full Demolition permits in DOB NOW will be required to certify on the PW2 that a licensed exterminator has been retained to effectively treat the premises for rodent extermination as per the requirements of DOHMH. In addition, applicants for Full Demolition permits in DOB NOW and the Buildings Information System (BIS) are required to submit a Rodent Control Required Item/Document prior to permit issuance.
